1. Introduction
eNight is an online social networking service that allows Members to create unique personal profiles online in order to find and communicate with other Members and organize social events. The eNight.com website ("Website"), the eNight service and network, eNight promotions and any other features, content, or applications offered from time to time by eNight are all hereinafter referred to collectively as the "Service". The Service is operated by eNight LLC and its affiliates (collectively, "us", "we" or the "Company").

2. Your privacy rights
The Company has created this privacy policy to demonstrate our firm commitment to protecting your profile information and informing you about how we handle it. This privacy policy only applies to transactions and activities in which you engage ("Transactions"), and data gathered, on the eNight.com web site (the "Website") and does not apply to any other web site or offline point of contact between eNight LLC, or any other company, and consumers. Please review this privacy policy periodically as we may modify it from time to time. Each time you use the Service or provide us with information, by doing so you are accepting the practices described in this privacy policy at that time.

By using the Service, you agree to be bound by the Terms of Use Agreement and by this Privacy Policy whether you are a "Visitor" (which means that you simply browse the Website) or you are a "Member" (which means that you have registered with eNight.com). The term "User" refers to a Visitor or a Member. Links to a copy of the Terms of Use Agreement can be found on the eNight Home Page.

To enhance our Members' experience, we request and display some personal information to other Members and Visitors, which allows our users to identify each other and expand their network of friends. Members can change their profile information at any time and can control how other Members and the Service communicates with them.

3. Your IP Address
Like most e-commerce websites, each time you visit the Website, we automatically collect your browser type, IP address and the web page from which you came. In order to administer and optimize the Website for you and to diagnose problems with our Website, we use your IP address to help identify you and to gather broad demographic information about you.

4. Security
Members' accounts are secured by Member-created passwords to insure that Member account information is kept private. We use reasonable measures to protect Member information that is stored within our database, and we restrict access to Member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. We cannot, however, guarantee the security of Member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of Member information at any time.

5. Cookies
Like most websites, the Website uses cookies to keep track of your purchases and other activity on the Site and enhance your experience on the Website. We also use cookies to deliver content specific to your interests, to save your password, and if you choose, to save other personal and financial information so you do not have to re-enter it each time you visit the Website.

Third parties that advertise on the Website may also place cookies on your browser. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you.

6. Information We Collect From You
In order to operate the Service and provide you with information on products and services that may be of interest to you, we may collect profile information (i.e. information that could be used to contact you such as full name, postal address, phone number and email address), financial information (e.g. passwords and credit card numbers), demographic information (e.g. zip code, hometown, gender, purchase history information and age), public information such as user ratings and reviews and a user name from you. You can change the personal information you've submitted to the eNight Website, including the information included in your profile, by clicking the "edit profile" link on your eNight profile page.

While communicating on the Website, Members may reveal personal information to other Members. Certain personal information, however, will be shown only to those people whom the Member chooses. Members have two options concerning the sharing of such personal information:
    I. "Friends" designated by the Member;
    II. "Anyone" visiting the eNight.com website who is also a Member.

If a Member wishes to invite a friend to become a Member of the Service, we request the friend's email address. eNight will then send the friend an email inviting them to join the site.

Except where a Member chooses to include a full name and email address in his or her "public profile", a Member's email address and full name will only be used when:
   
  • the Member invites a friend to become a Member;
       
  • the Member sends a request to another Member to add the other Member to his or her "Friends List";
       
  • we send notifications relating to the Member's use of the Service; and
       
  • when we send notifications, updates, or other news regarding the Service.

    7. Links
    On the Website, we place links to other web sites operated by other parties. Some of these other web sites contain our brand names and trademarks and other intellectual property that we own; others do not. When you click on these links and visit these other web sites, regardless of whether or not they contain our brand names, trademarks and other intellectual property, you need to be aware that we do not control these other web sites or these other web sites' business practices, and that this privacy policy does not apply to these other web sites. Consequently, the operators of these other web sites may collect different kinds of information about you, and may use and disclose that information in different ways than we would if it were collected on the Website. We encourage you to review their privacy policies and remind you that we will not be responsible for their actions.

    8. How We Use Personal Information
    We use your profile information to help us efficiently perform Transactions on the Site, to contact you when necessary in connection with Transactions, and to send you information, offers and other promotional materials. Users may choose not to receive email of this type by changing their "notification" setting to "Do not send me notification emails" in the user "Account Settings"

    Please note that changing or deleting your information through Account Settings, or otherwise opting-out of receipt of email communications from eNight.com will only change or delete the data in our My Profile database for purposes of future Transactions on the Website and for managing future communications from eNight.com. These changes and deletions will not change or delete information that we may have already forwarded to credit card companies or any other third parties, all as provided above in this privacy policy.

    To process Transactions on the Site, we may share your profile information with our agents, representatives, contractors and service providers so they can provide us with support services such as authorization of credit card transactions, order fulfillment and sweepstakes and promotional fulfillment. We require these entities not to use your information for any other purpose.

    By purchasing or making reservations for products or services, electing to receive communications (such as emails or magazine subscriptions), or electing to participate in contests, sweepstakes, or other programs (such as discount or rewards programs), offered by third parties on the Website, you consent to our providing your profile information to those third parties. Those third parties may use your personal information in accordance with their own privacy policies. You will need to contact those third parties to instruct them directly regarding your preferences for the use of your personal information by them. Additionally, you agree that we will have the right to use and disclose all such information you submit in the same manner in which we use and disclose all other information you submit.

    Any third party with whom we are allowed to share your profile information is authorized to use your profile information in accordance with our contractual arrangements with such third parties and in accordance with their own privacy policies, over which we have no control, and you agree that we are not responsible or liable for any of their actions or omissions. Those who contact you will need to be instructed directly by you regarding your preferences for the use of your profile information by them.

    9. Sharing and Disclosure of Information eNight.com Collects
    Except as otherwise described in this privacy statement, we will not disclose personal information to any third party unless we believe that disclosure is necessary: (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by enight.com, whether or not a response is required by

    applicable law; (2) to enforce the eNight.com Terms of Use Agreement or to protect our rights; or (3) to protect the safety of members of the public and users of the Service. We reserve the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of the Company or substantially all of its assets to that successor in interest.

    eNight may share profile information and aggregate usage information in a non-personally identifiable manner with advertisers and other third parties in order to present to Members and other users of the eNight website more targeted advertising, products and services. In such situations we will never disclose information that would personally identify you.

    10. Changes in Our Privacy Policy
    If we change our privacy policy, we will post those changes on our web site so Members and other users of the Service are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If we are going to use Members' or other users' personally identifiable information in a manner different from that stated at the time of collection, we will notify those Members and users via email or by placing a prominent notice on our website.
